General Terms and Conditions (GTC)

for the sale of digital escape-room games (PDF downloads)

1. Scope

1. These GTC apply to all contracts concluded by consumers or entrepreneurs (§§ 13, 14 BGB) via the online shop escape-set.com with Dreamly Colors GmbH, Im Kreuzfeld 1, 34292 Ahnatal, Germany, e-mail: info@escapesets.com (hereinafter “we” or the “Seller”).

2. We sell digital content only (§ 312f BGB) in the form of PDF files (escape-room games) for download. No physical goods are shipped.

3. Conflicting or supplementary terms and conditions of the customer shall not apply unless we expressly agree to their validity in writing.

2. Contracting Party & Conclusion of Contract

1. The contracting party is Dreamly Colors GmbH.

2. The presentation of products in the shop constitutes a binding offer to conclude a purchase contract.
   The customer can add products to the cart by clicking “Add to cart” and may change or delete them at any time.
   By clicking the button “Order with an obligation to pay”, the customer accepts the offer; the contract is thereby concluded (§ 312j (4) BGB).

3. Immediately after submitting the order, the customer receives an automatic e-mail confirmation containing the contract data (invoice, download link, GTC, withdrawal information).

3. Contract Language & Storage

1. The contract language is German.

2. We store the contract text on internal systems; the customer receives the documents permanently by e-mail. For security reasons, retrieval via the internet is not possible.

4. Provision of Digital Content

1. The download link is displayed immediately after payment in the browser and sent by e-mail.

2. To open the PDF file, the customer requires suitable software (e.g., Adobe Reader).

3. The Seller is responsible only for providing the digital content; ensuring functionality on the customer’s hardware is their own responsibility.

5. Prices & Payment

1. All prices are in euros and include statutory VAT.

2. The checkout offers the following payment-service-dependent options (technical providers: PayPal, Stripe, Klarna, etc.):
   • Credit Card
   • PayPal
   • Klarna SOFORT / Invoice (DE consumers only)
   • Google Pay / Apple Pay
   The charge is made immediately after the order is completed.

3. No shipping costs apply – digital products only.

6. Right of Withdrawal for Consumers

Consumers generally have a 14-day right of withdrawal.
Note: For our digital content, the right of withdrawal expires prematurely as soon as the download begins, provided the customer

• (a) has expressly consented to our starting performance before the withdrawal period expires, and

• (b) has confirmed awareness that this results in the loss of the right of withdrawal (§ 356 (5) BGB).
  Details are contained in the separate withdrawal notice.

7. Usage Rights

1. Upon full payment, the customer receives a simple, non-transferable right to print and use the PDF for private purposes.

2. Resale, public performance, electronic distribution, or commercial use are not permitted unless expressly licensed.

8. Warranty & Liability

1. The statutory warranty law applies (§§ 434 et seq. BGB).

2. For entrepreneurs, the limitation period for warranty claims is 12 months from the date of provision (§ 438 (1) No. 3 BGB); § 377 HGB remains unaffected.

3. The Seller is liable without limitation for intent, gross negligence, and for injury to life, body, or health.
   In cases of slight negligence, we are liable only for damages resulting from breaches of essential contractual obligations (cardinal duties) and limited to the typically foreseeable damage.

9. Dispute Resolution

1. The European Commission provides an Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr

2. We are neither obliged nor willing to participate in a consumer dispute resolution procedure.

10. Final Provisions

1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

2. If the customer is a merchant, legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes is our registered office in 34292 Ahnatal.

3. Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall not be affected.
